Courts Threaten Charter Schools

Efforts to save local charter schools continue in a number of states where recent court rulings have limited how a charter school is authorized. Authorizers have tended to be local school boards, certified non-profits and colleges.

In spite of the success of the charter school system in Georgia, its State Supreme Court recently ruled that only local school boards can be authorizers. State law allowed for the creation of a commission to serve as an independent authorizer of charter schools. The state Supreme Court ruled that the law creating the commission is unconstitutional. The Georgia commission has approved 16 schools, eight of which are currently open and proving quite successful.

Charter school proponents realize the effort to save local charter schools will not be resolved quickly. National and local teachers unions and those opposed to any private control of education will continue to oppose charter schools.
